This document has been prepared in order to comply with the information obligation under Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.04.2016 on the protection of individuals with regard to the processing of personal data on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation) (Official Journal of the EU L119 of 4.05.2016).

In accordance with the requirements of art.13 RODO (Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016. on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC) Tropical Tadeusz Ogrodnik informs that it processes personal data and is its Administrator pursuant to Art. 6(1) RODO. Individuals whose personal data is processed by Tropical Tadeusz Ogrodnik have the right to access the content of their data and to request its correction, completion, rectification, transfer, forgetting or restriction of processing, and have the right to object to its processing. This right can be exercised at the headquarters of Tropical Tadeusz Ogrodnik in Chorzow ul. Opolska 25.

Personal data means information about an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by means of an identifier such as a name, an identification number, location data, an online identifier, or one or more specific physical, physiological, genetic, mental, economic, cultural or social characteristics.

Any owner of personal data has the right to request from Tropical Tadeusz Ogrodnik access to their personal data, rectification, erasure, portability or restriction of processing, or the right to object to its processing. The scope of personal data processed is based on the applicable laws and data is processed under Art. 6(1) Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016. on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC.

Tropical Tadeusz Ogrodnik also informs about the right to lodge a complaint to the Supervisory Authority, in accordance with the provisions of the Personal Data Protection Act, in the event that the processing of such data is found to be inconsistent with applicable national and European law. The Supervisory Authority is the Office for Personal Data Protection in Warsaw, ul. Stakes 2.

Fulfilling our duty of information to owners of personal data with whom we contact via ICT, we would like to inform you that your e-mail address or telephone number is processed in our company for the purpose of communication, on the basis of Article 6(1)(f) RODO. Scope of data processed: e-mail address, telephone number, name, address, first and last name, content of information, in case:

a). Potential contractors

The data was collected on the basis of voluntary consent, which can be withdrawn at any time. Failure to provide consent or withdrawal of consent will entail the inability to contact and to prepare the Administrator’s marketing offers. If you agree to receive a newsletter, information about which brand of our products you have chosen is also processed.

b). Contractors

Your personal data is processed in our company for the purposes of business cooperation or delivery/purchase of goods and services and is processed within the scope of the concluded contract of sale or other business agreement on the basis of Article 6(1)(b) RODO. In terms of fulfilling legal obligations (tax purposes, accounting, claim enforcement), data is processed on the basis of art.6.1.c) RODO, and in terms of debt collection and legal services, data is processed on the basis of art.6.1.f) RODO. Provision of data for the purpose of cooperation is necessary for the implementation of the purchase or service and the issuance of an invoice, and failure to provide them prevents the execution of a specific business event.

c). Employees

Your personal data is processed in our company for employment purposes and is processed within the scope of the concluded contract and other ancillary contracts on the basis of Article 6(1)(b) RODO. In terms of fulfillment of obligations under the law (tax, accounting, pension provision, occupational health and safety, training, time accounting, social purposes), data are processed on the basis of art.6.paragraph.1 lit.c).

Provision of data for employment purposes is a statutory requirement and failure to provide it prevents employment.

Personal data was obtained from various sources, viz:

Directly from you, which we consider as giving your consent by performing a specific activity or signing a consent to tele-communication contact from public websites (categories: ordinary data, e-mail address, telephone number, name or first and last name, address)

The data will be processed until we receive an objection to its processing or a request for its deletion, unless the law obliges Tropical to continue processing the data or its processing is otherwise legally permissible.

The recipients of your personal data are specified in the law and include companies that operate information systems.

The aforementioned data are not shared with anyone without the consent of the data subject, unless the sharing is required to settle a matter in the legitimate interest of the Administrator, e.g. in the field of technical handling of correspondence, the data are shared with the Polish Post, couriers, suppliers, hosting services, telecommunications operators, companies operating IT systems.
